Wayner Trough Covers Canada
Wayner Trough Covers Canada warrants that the gutter guard products we supply and install are free from defects in material and workmanship at the time of installation. The finish on the product will not chip, peel, or blister under normal environmental conditions and ordinary use.
This warranty is subject to the terms, conditions, exclusions, and limitations outlined below.
Wayner Trough Covers Canada warrants to the original purchaser that, when properly installed by our team, the gutter guard system will prevent gutters and downspouts from becoming clogged to the point of overflow due to common debris such as leaves, twigs, needles, and seeds.
If clogging occurs under normal conditions, we will inspect the system and, if covered under this warranty, remedy the issue in accordance with this agreement.
This warranty applies only to products supplied and installed by Wayner Trough Covers Canada.
This warranty is non-transferable and applies only to the original property owner at the original installation address.
We reserve the right to modify product design, materials, or specifications at any time without notice.
If the original product is no longer available at the time of a claim, we may substitute a comparable product of equal value and performance.
Due to natural weathering, replacement materials may vary slightly in colour or finish from the original installation.
Our liability under this warranty is limited strictly to the repair or replacement of defective materials. Labour, removal, disposal, or reinstallation costs may be excluded at our discretion unless otherwise stated in writing.
Except as expressly stated, this warranty replaces all other warranties, whether express or implied, including any implied warranties of merchantability or fitness for a particular purpose, to the extent permitted by Ontario law.
The gutter guard system is designed to be low maintenance; however, periodic care is required:
Occasional rinsing with a garden hose is recommended
A soft-bristle brush may be used to remove stubborn debris
Mild cleaning solutions may be used if necessary
Organic buildup (mold, mildew, etc.) should be cleaned using appropriate diluted cleaning solutions
Failure to perform reasonable maintenance may void this warranty.
This warranty does not cover damage or failure resulting from:
Severe weather or “acts of God” (including windstorms, hail, flooding, ice damage, etc.)
Improper installation by any party other than Wayner Trough Covers Canada
Structural issues with the home (settling, shifting, roof or fascia failure)
Lack of proper maintenance
Alteration, modification, or removal of the system
Use with incompatible or non-approved products
Damage caused by chemicals, environmental pollutants, or salt exposure
Fire, vandalism, or external impacts
Normal wear and tear, including fading, staining, or surface weathering
Accumulation of substances such as roof oils, tar, sap, paint, or animal/insect debris that may affect performance
To make a claim under this warranty:
The property owner must notify Wayner Trough Covers Canada in writing within a reasonable timeframe after discovering the issue
We reserve the right to inspect the installation before approving any claim
Approved claims will be resolved within a reasonable time based on scheduling and seasonal conditions
Any disputes arising from this warranty shall first be addressed through good-faith negotiation between both parties.
If a resolution cannot be reached, disputes shall be handled in accordance with the laws of the Province of Ontario and applicable Canadian law.
This warranty provides specific legal rights. You may have additional rights under Ontario consumer protection laws, which vary depending on your circumstances.
